Travseek: Terms of Use

Welcome to Travseek (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Travseek website and platform (the “Platform”). By accessing the Platform or making a booking, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Platform.

1. Our Role as an Intermediary

  1. Travseek is a Platform: We provide an online marketplace that connects users looking for travel experiences (“Travelers”) with independent third-party providers (“Suppliers”) of those experiences.
  2. Not a Service Provider: Travseek does not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any travel experiences, tours, or transportation.
  3. Contractual Relationship: When you make a booking, you are entering into a contract directly with the Supplier. Travseek is not a party to that contractual relationship. We act solely as an agent for the Supplier to facilitate the transaction.

2. Booking and Payments

  1. Booking Confirmation: A booking is only confirmed when you receive a confirmation email from us.
  2. Pricing: All prices are displayed in INR/AUD/EUR/SGD/USD and are subject to change by Suppliers without prior notice until the booking is confirmed.
  3. Payment Collection: Travseek collects payments on behalf of the Supplier. Payment to Travseek extinguishes your debt to the Supplier for that specific transaction.
  4. Taxes: Unless otherwise stated, prices may be inclusive of GST (Goods and Services Tax) where applicable under Singapore law.

3. Cancellations and Refunds

  1. Supplier Policies: Because you are contracting with the Supplier, your booking is subject to the Supplier’s cancellation and refund policy, not ours. These policies are displayed on the booking page.
  2. Processing: If a refund is due according to the Supplier’s policy, Travseek will process this refund. However, we are not liable for any delays caused by the Supplier or banking institutions.

4. Limitation of Liability

  1. Please read this section carefully. It limits our liability to you to the fullest extent permitted by Singapore law
  2. Disclaimer of Supplier Acts: Travseek assumes no liability for any acts, errors, omissions, representations, warranties, breaches, or negligence of any Supplier. We are not liable for any personal injuries, death, property damage, or other damages or expenses resulting from the Supplier’s services.
  3. Platform “As Is”: The Platform is provided on an “as is” and “as available” basis. We do not guarantee that the Platform will be uninterrupted, virus-free, or error-free.
  4. Exclusion of Damages: To the maximum extent permitted by law, Travseek shall not be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, your access to the Platform or your booking of an experience.
  5. Cap on Liability: In the event that Travseek is found liable for any loss or damage despite the exclusions above, our aggregate liability shall in no event exceed the transaction fees retained by Travseek for the specific booking giving rise to the claim (excluding the cost of the experience paid to the Supplier)

Note on Singapore Law: Under the Unfair Contract Terms Act (Cap. 396), we cannot exclude liability for death or personal injury resulting specifically from our own negligence (e.g., a data breach causing harm). However, we can and do exclude liability for the negligence of the Suppliers.

5. Indemnification

You agree to defend and indemnify Travseek, its affiliates, directors, and employees from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties, or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

                                      • Your breach of these Terms;
                                      • Your violation of any law or the rights of a third party; or
                                      • Your use of this Platform.

6. Traveler Obligations

  1. Suitability: You acknowledge that travel involves inherent risks. It is your responsibility to determine if an experience is suitable for your physical and medical condition.
  2. Documents & Insurance: You are solely responsible for ensuring you have valid travel documents (passports, visas) and adequate travel insurance. Travseek is not liable for denied entry or lack of insurance coverage.

7. Intellectual Property

All content on this Platform, including text, graphics, logos, and software, is the property of Travseek or its content suppliers and is protected by Singapore and international copyright laws.

8. Governing Law and Jurisdiction

  1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore.
  2. Dispute Resolution:
  • Negotiation: In the event of a dispute, the parties agree to first attempt to resolve the matter amicably through good faith negotiations.
  • Jurisdiction: If the dispute cannot be resolved, you agree to submit to the exclusive jurisdiction of the courts of Singapore.

9. Personal Data

By using the Platform, you agree to the collection and use of your personal data in accordance with our Privacy Policy and the Personal Data Protection Act 2012 (PDPA) of Singapore.
